1. Taraflar ve Sözleşmenin Konusu Bu Kullanıcı Sözleşmesi ("Sözleşme"), Bino Pulse Pro adlı mobil ve/veya web uygulamasının sahibi ve geliştiricisi olan şirket veya kişi ("Hizmet Sağlayıcı") ile Uygulama'yı kullanan tüm gerçek ve tüzel kişiler ("Kullanıcı") arasında akdedilmiştir. Sözleşmenin amacı, Uygulama'nın kullanımı, sunulan hizmetlerin niteliği, tarafların hak ve yükümlülükleri ile sorumluluk redleri konularını düzenlemektir.
 

2. Hizmetin Tanımı ve Kapsamı 2.1. Bino Pulse Pro, uluslararası açık kaynak veri sağlayıcılarından toplanan verileri kullanarak online ticaret faaliyetlerine yönelik analizler, grafikler ve sinyaller üreten yardımcı bir yazılımdır. Uygulama, piyasa eğilimlerini, potansiyel fırsatları veya riskleri belirlemek için bir araç olarak tasarlanmıştır. 2.2. Uygulama tarafından sağlanan tüm veriler, analizler, sinyaller ve öngörüler yalnızca eğitim ve bilgi amaçlıdır. Bunlar, yatırım tavsiyesi, finansal danışmanlık veya ticari bir işlem yapma yönünde bir teşvik olarak değerlendirilemez. Uygulama, Kullanıcıların kendi analizlerini ve kararlarını desteklemek için bir kaynak sunar. 2.3. Uygulama, herhangi bir ticaret platformu, aracı kurum veya finansal kuruluş ile ortaklık, işbirliği veya herhangi bir ticari ilişki içinde değildir. Uygulama'nın sunduğu hizmetler, Kullanıcının mevcut ticaret platformundaki hesabına erişim sağlamaz ve herhangi bir ticari emri otomatik olarak gerçekleştirmez.
 

3. Sorumluluk Reddi Beyanı ve Risk Uyarısı 3.1. Finansal Riskler: Ticaret ve finansal piyasalar, yüksek riskler içermektedir. Kullanıcı, sermayesinin tamamını veya bir kısmını kaybetme riski de dahil olmak üzere, ticaretin tüm risklerinin farkındadır ve bu riskleri kendi isteğiyle kabul eder. 3.2. Sorumluluk Reddi: Hizmet Sağlayıcı, Uygulama'nın sunduğu analizler veya sinyaller temelinde yapılan ticari işlemlerden doğan herhangi bir maddi veya manevi zarardan sorumlu tutulamaz. Uygulama'nın verileri, piyasa hareketlerinin tahminine yönelik olsa da, finansal piyasaların öngörülemez doğası nedeniyle hatalı, eksik veya güncel olmayan bilgiler içerebilir. 3.3. Veri Kaynağı: Uygulama, verileri uluslararası açık kaynaklardan temin etmektedir. Hizmet Sağlayıcı, bu verilerin doğruluğu, güvenilirliği veya eksiksizliği konusunda herhangi bir garanti veya beyan vermez. Kullanıcının, bu verilere ek olarak kendi araştırmalarını yapması ve profesyonel finansal danışmanlık alması önemle tavsiye edilir. 3.4. Kesintisiz Hizmet Garantisi: Hizmet Sağlayıcı, Uygulama'nın kesintisiz, hatasız veya virüssüz çalışacağını garanti etmez. Uygulamanın erişilebilirliğindeki kesintiler, teknik arızalar veya sistem bakımları nedeniyle oluşabilecek zararlardan sorumlu değildir.
 

4. Kullanıcının Yükümlülükleri 4.1. Yaş Sınırlaması: Uygulama, yalnızca reşit olan ve yasal olarak bağlayıcı bir sözleşme yapma ehliyetine sahip olan kişiler tarafından kullanılabilir. 4.2. Uygun Kullanım: Kullanıcı, Uygulama'yı yalnızca yasalara ve bu Sözleşme'nin hükümlerine uygun olarak kullanacağını taahhüt eder. Uygulama'nın kötüye kullanılması, manipülasyonu veya telif haklarına aykırı kullanımı kesinlikle yasaktır. 4.3. Güvenlik: Kullanıcı, hesap bilgileri ve şifresinin gizliliğinden tamamen sorumludur. Hesabının izinsiz kullanımı durumunda Hizmet Sağlayıcı'ya derhal bildirimde bulunmakla yükümlüdür.
 

5. Fikri Mülkiyet Hakları 5.1. Mülkiyet Hakkı: Bino Pulse Pro uygulamasının tüm fikri mülkiyet hakları, tescilli markaları, ticari unvanı, kaynak kodu, algoritmaları, veri tabanları, arayüzü ve tüm içeriği Hizmet Sağlayıcı'ya aittir ve uluslararası telif hakları yasaları ile korunmaktadır. 5.2. Kullanım Kısıtlaması: Kullanıcıya, Uygulama'yı yalnızca bu Sözleşme'de belirtilen şartlar doğrultusunda kullanma lisansı verilmiştir. Uygulama'nın veya içeriğinin herhangi bir bölümünün izinsiz olarak kopyalanması, çoğaltılması, tersine mühendislik yapılması, satılması veya ticari amaçlarla kullanılması kesinlikle yasaktır.
 

6. Sözleşmenin Feshi 6.1. Hizmet Sağlayıcı Tarafından Fesih: Hizmet Sağlayıcı, Kullanıcının bu Sözleşme hükümlerine uymaması durumunda, herhangi bir zamanda ve bildirimde bulunarak Kullanıcının Uygulama'ya erişimini derhal sonlandırma hakkını saklı tutar. 6.2. Kullanıcı Tarafından Fesih: Kullanıcı, Uygulama'yı kullanmayı dilediği zaman durdurarak bu Sözleşmeyi sonlandırabilir.
 

7. Genel Hükümler 7.1. Genel Hükümler 7.1. St. Vincent ve Grenadinler yasaları geçerlidir. 7.2. Değişiklikler yayınlandığı anda yürürlüğe girer.. 7.2. Değişiklikler: Hizmet Sağlayıcı, bu Sözleşmenin hükümlerini tek taraflı olarak, herhangi bir zamanda ve kendi takdirine bağlı olarak değiştirme hakkını saklı tutar. Değişiklikler, Uygulama'da veya ilgili web sitesinde yayınlandığı andan itibaren geçerli olur. Kullanıcının Uygulama'yı kullanmaya devam etmesi, bu değişiklikleri kabul ettiği anlamına gelir.

1. Parties and Subject of the Agreement This User Agreement ("Agreement") is entered into between the company or individual who is the owner and developer of the mobile and/or web application named Bino Pulse Pro ("Service Provider") and all natural and legal persons who use the Application ("User"). The purpose of this Agreement is to regulate the use of the Application, the nature of the services provided, the rights and obligations of the parties, and the disclaimers of liability.

2. Description and Scope of Service 2.1. Bino Pulse Pro is a supplementary software that generates analyses, charts, and signals for online trading activities, using data collected from international open-source data providers. The Application is designed as a tool to identify market trends, potential opportunities, or risks. 2.2. All data, analyses, signals, and predictions provided by the Application are for educational and informational purposes only. They cannot be considered as investment advice, financial counseling, or an inducement to make a commercial transaction. The Application provides a resource to support the User's own analyses and decisions. 2.3. The Application has no partnerships, collaborations, or any commercial relationship with any trading platform, brokerage, or financial institution. The services offered by the Application do not provide access to the User's account on their existing trading platform and do not automatically execute any commercial orders.

3. Disclaimer of Liability and Risk Warning 3.1. Financial Risks: Trading and financial markets involve high risks. The User is aware of and voluntarily accepts all risks of trading, including the risk of losing all or part of their capital. 3.2. Disclaimer of Liability: The Service Provider shall not be held liable for any financial or non-financial damages resulting from commercial transactions made on the basis of the analyses or signals provided by the Application. While the Application's data is intended to forecast market movements, it may contain inaccurate, incomplete, or outdated information due to the unpredictable nature of financial markets. 3.3. Data Source: The Application obtains its data from international open sources. The Service Provider makes no guarantees or representations regarding the accuracy, reliability, or completeness of this data. Users are strongly advised to conduct their own research and seek professional financial advice in addition to using this data. 3.4. No Service Guarantee: The Service Provider does not guarantee that the Application will operate without interruptions, errors, or viruses. It is not responsible for any damages that may arise from interruptions in the Application's accessibility, technical failures, or system maintenance.

4. User Obligations 4.1. Age Restriction: The Application may only be used by individuals who are of legal age and have the capacity to enter into a binding contract. 4.2. Proper Use: The User agrees to use the Application only in compliance with the law and the provisions of this Agreement. Misuse, manipulation, or copyright infringement of the Application is strictly prohibited. 4.3. Security: The User is solely responsible for the confidentiality of their account information and password. They are obligated to immediately notify the Service Provider in the event of unauthorized use of their account.

5. Intellectual Property Rights 5.1. Ownership: All intellectual property rights, registered trademarks, trade names, source code, algorithms, databases, interface, and all content of the Bino Pulse Pro application belong to the Service Provider and are protected by international copyright laws. 5.2. Usage Restriction: The User is granted a license to use the Application only in accordance with the terms specified in this Agreement. Unauthorized copying, reproduction, reverse engineering, selling, or commercial use of any part of the Application or its content is strictly prohibited.

6. Termination of the Agreement 6.1. Termination by the Service Provider: The Service Provider reserves the right to terminate the User's access to the Application immediately and without notice if the User fails to comply with the provisions of this Agreement. 6.2. Termination by the User: The User may terminate this Agreement at any time by simply ceasing to use the Application.

7. Miscellaneous Provisions 7.1. Governing Law & Amendments Laws of the St. Vincent ve Grenadines apply. Terms may be amended unilaterally upon publication. 7.2. Amendments: The Service Provider reserves the right to unilaterally amend the terms of this Agreement at any time and at its sole discretion. The amendments will become effective from the moment they are published on the Application or the relevant website. The User's continued use of the Application signifies their acceptance of these changes.
